Coaching Agreement // Terms and Conditions

Please carefully read the following terms and conditions (the “Terms”) relating to your purchase of one-on-one coaching (the “Services”) with Kristin Vanderlip. By registering for the Services, you agree to these terms and conditions. If you cannot assent to these terms and conditions, you should not purchase the Service

Description of Coaching:

Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach (Kristin Vanderlip) and the Client (you) in a thought-provoking and creative process for the purpose of inspiring you to embrace and maximize your writing potential. It is designed to facilitate the creation/development of personal, professional, and/or business goals and to support you in developing and carrying out a strategy/plan for achieving those goals.

Coach-Client Relationship:

Kristin Vanderlip agrees to maintain the ethics and standards of behavior established by the International Coach Federation “(ICF)” (Coachfederation.org/ethics).

You, the Client, understand and agree that you are solely responsible for creating and implementing your own physical, mental and emotional well-being, decisions, choices, actions, and results arising out of or resulting from the coaching relationship and your coaching calls and interactions with Kristin Vanderlip. As such, you understand and agree that Kristin Vanderlip is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by Kristin Vanderlip. You also understand that coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.

You understand that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association. You understand and agree that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is your exclusive responsibility to seek such independent professional guidance as needed.

You understand and agree that in order to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.

Services & Procedures:

You understand and agree that the time of the coaching session(s) and will be determined by Kristin Vanderlip and you based on a mutually agreed upon time. All meetings will occur via a private Zoom link emailed to you by Kristin Vanderlip at least 24 hours prior to scheduled session.

The parties agree to engage in virtual one-on-on coaching sessions held on Zoom for the number of session minutes and number of sessions determined by the services you purchase. You understand that Kristin Vanderlip will be available to you by e-mail in between scheduled meetings for the purpose of sharing progress and to notify Kristin Vanderlip of cancellations and/or requests to reschedule, which must be sent at least 24 hours in advance of the scheduled session (see Cancellation and Refund Policies below).

Payment:

Payment in full will be received by Kristin Vanderlip in cleared funds no later than five (5) business days before the date of commencement of the Services. Any scheduled Services will be postponed until funds clear and payment is made in full.

Cancellation and Refund Policies:

Scheduling of the Services will be done through a digital system and is booked based on the mutual availability of the parties. Any and all payments made in connection with the Services secure your space to the exclusion of another, and said payments are, therefore, considered non-refundable. You understand that your success and progress depend upon your commitment and investment.

You understand and agree that any cancellations and requests to reschedule must be emailed to Kristin Vanderlip at least 24 hours prior to your scheduled Service. No-shows, reschedule requests, or cancellations received without adequate notice (at least 24 hours prior to scheduled Service) are non-refundable. You understand that you will be charged full price for the missed Service. It is your responsibility to reschedule missed sessions. You are considered a non-show 10 minutes past the start time of your scheduled Service.

Confidentiality:

You understand and agree that this coaching relationship, as well as all information (documented or verbal) that you share with Kristin Vanderlip as part of this relationship, is bound by the principles of confidentiality set forth in the ICF Code of Ethics. However, please be aware that the Coach-Client relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. Kristin Vanderlip agrees not to disclose any information pertaining to you without your written consent.

You understand and agree that the materials and information presented in the Services are my confidential, copyrighted, and proprietary information and that you will not record, duplicate, distribute, teach or train from the materials without my express written permission. Any unauthorized use or distribution of this Intellectual Property is prohibited and may result in further legal action.

Limited Liability:

You understand, as expressly provided in this Agreement, Kristin Vanderlip makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the Services negotiated, agreed upon and rendered. In no event shall Kristin Vanderlip be liable to you for any indirect, consequential, or special damages. Notwithstanding any damages that you may incur, Kristin Vanderlip’s entire liability under this Agreement, and your exclusive remedy, shall be limited to the amount actually paid by you to Kristin Vanderlip under this Agreement for all Services rendered.

Binding Effect:

This Agreement shall be binding for you and Kristin Vanderlip upon your purchase and full payment rendered for the Services.

General Terms and Conditions:

You understand that I have made every opportunity to adequately represent the Services and the potential outcomes. However, you understand that individual results and progress are your responsiblity. I cannot make any guarantees, representations, or warranties regarding any results or outcomes from your participation in the Services. By enrolling in the Services, you agree that neither I, nor anyone associated with the Services, shall be held liable for any direct, indirect, punitive, special, incidental, or other consequential damages, or any other economic loss arising directly or indirectly from the Services.

Relationship to the Parties:

I am an independent contractor and nothing in these Terms will be construed as establishing an employment or agency relationship between us.

Agreeing to Terms and Conditions:

If you have read and agree to the Terms and Conditions, visit my shop to secure your spot and purchase the Services. Your purchase of the Services indicates you agree to these Terms and Conditions.
